2. Website Information
We take reasonable care to ensure that information displayed on our website is accurate and up to date.
Vehicle descriptions, specifications, mileage, photographs, prices and other information are provided in good faith. However, customers should verify any feature or specification that is particularly important to them before purchasing a vehicle.
Website information does not constitute a contractual offer. A contract for the purchase of a vehicle is only formed once the terms of sale have been agreed and accepted by us.
3. Vehicle Availability
All vehicles are subject to availability and may be withdrawn from sale at any time.
A vehicle appearing on our website does not guarantee that it remains available.
Vehicles may be advertised simultaneously through other sales channels.
4. Vehicle Descriptions
We make reasonable efforts to describe vehicles accurately.
Used vehicles will normally show signs of age and use consistent with their mileage, age and previous ownership.
Any known material information relating to a vehicle will be disclosed where required.
Customers are encouraged to inspect and test drive a vehicle before completing a purchase where practical.
Nothing in these Terms affects your statutory rights.
5. Prices
Unless otherwise stated, advertised prices are in pounds sterling (£).
The advertised price relates to the vehicle specified and may exclude optional products or services including, where applicable:
• delivery;
• extended warranties;
• finance products;
• additional preparation requested by the customer;
• cherished registration transfers; or
• other separately agreed services.
We reserve the right to correct genuine pricing or typographical errors before a contract is entered into.
6. Deposits and Reservations
A deposit may be requested to reserve a vehicle.
Before taking a deposit, we will explain:
• the amount;
• how long the vehicle will be reserved;
• whether the deposit is refundable; and
• any relevant conditions.
The treatment of a deposit will depend upon the circumstances of the transaction and applicable consumer law.
Nothing in these Terms removes any cancellation or refund rights a consumer has by law.
7. Payment
Full cleared payment must normally be received before a vehicle is released.
We may accept payment by methods including bank transfer, debit card, finance provider payment or another payment method agreed with us.
For fraud-prevention purposes we may request identification or evidence relating to the source or ownership of a payment where reasonably necessary.
8. Part Exchange
Any part-exchange valuation is based upon the information supplied by the customer and our subsequent inspection of the vehicle.
We may adjust or withdraw a valuation where:
• the vehicle’s condition differs materially from that described;
• mileage is inaccurate;
• undisclosed damage is discovered;
• mechanical faults are identified;
• vehicle history differs from information supplied; or
• finance or another financial interest remains outstanding.
The customer must have the legal right to sell or part exchange the vehicle.
9. Finance
Where finance is available, finance is subject to status, eligibility and approval by the relevant finance provider.
Any monthly payment figures displayed on our website are illustrative unless expressly stated otherwise.
CarLuxe does not guarantee that finance will be available to any particular applicant.
Where applicable, relevant FCA disclosures and finance-provider terms will be provided separately.
10. Consumer Rights
Nothing in these Terms limits or excludes any statutory rights available to consumers.
Vehicles supplied to consumers must meet the requirements imposed by applicable UK consumer legislation, including requirements concerning satisfactory quality, fitness for purpose and correspondence with description.
11. Distance and Online Sales
Where a qualifying consumer contract is concluded entirely by distance communication without the customer’s physical presence, the Consumer Contracts Regulations may provide additional cancellation rights.
For many distance sales of goods, the statutory cancellation period extends to 14 days after the consumer receives the goods.
Where these rules apply to a vehicle sale, CarLuxe will provide the customer with the required information concerning cancellation and return arrangements.
Any statutory rights will take precedence over inconsistent wording elsewhere in these Terms.
12. Vehicle Collection and Delivery
Collection or delivery arrangements will be agreed individually.
Risk in the vehicle will pass in accordance with applicable law and the terms agreed for the particular transaction.
Where delivery is requested, additional charges may apply.
Customers should inspect the vehicle promptly following collection or delivery and contact us if they believe there is an issue.
13. Warranties
Any warranty supplied with a vehicle will be subject to its own terms and conditions.
A warranty is additional to, and does not replace, statutory consumer rights.
14. Vehicle Images
Vehicle photographs are intended to represent the actual vehicle offered for sale unless clearly identified otherwise.
Backgrounds may be digitally cleaned, replaced or enhanced for presentation purposes.
Vehicle features, specification and condition should be confirmed before purchase.
15. Intellectual Property
The CarLuxe name, CARLUXÉ branding, logo, website design, photographs, graphics and written content are owned by us or used with permission.
They may not be copied, reproduced or commercially used without prior written permission.
16. Website Availability
We do not guarantee that our website will always be available or uninterrupted.
We may update, suspend or modify any part of the website without notice.
17. External Websites
Our website may contain links to third-party websites.
We are not responsible for the content, security or privacy practices of third-party websites.
18. Liability
Nothing in these Terms excludes liability where exclusion would be unlawful, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.
Nothing in these Terms limits statutory consumer rights.
19. Changes to These Terms
We may update these Terms periodically.
The latest version will always be displayed on our website with its effective date.
20. Governing Law
These Terms are governed by the laws applicable in England and Wales, unless mandatory consumer law requires otherwise.
